The section 377 was introduced by Britishers, based on the Buggery Act of 1533. The section of Buggery Act was drafted by Thomas Macaulay in 1838. According to it ‘buggery’ is an unnatural sexual act against the will of God, laws of nature and man, thus, criminalising anal penetration, and homosexuality, in a clear sense.
Supreme court decision in section 377
The Supreme Court (SC) bench comprising of Chief Justice of India (CJI) Dipak Misra, Justices R F Nariman, A M Khanwilkar, D Y Chandrachud and Indu Malhotra on 6 september ruled that consensual adult gay sex is not a crime saying sexual orientation is natural and people have no control over it. The following decision has defanged the British made Section 377 of the Indian Penal Code (IPC), which states that gay sex is a punishable offence. But now, it is no longer an offence to include in consensual gay sex in private. This was welcomed by the LGBT community and specially by the Indian film fraternity.
The role of court in section 377
A lot of people put forward this point to justify the removable of section 377 that it’s the decision of court and it should be accepted by everyone but they forget that the same court overruled the decision of Delhi High Court of 2009 of decriminalising section 377 in 2012 now the same court has decriminalised Section 377. It is clearly visible that the decision of court is not the only parameter to term something correct or incorrect. In such a situation one must follow his own conscience which should be based on the cultural ethos and the future aspects.
Mental illness can’t be called as Right to Love
If in our surroundings someone is committing a mistake then it’s our duty to correct him. Homosexuality is also one such thing about which we need to tell others that it’s wrong rather than allowing them to indulge in this mental illness. If a person knows that he is committing a mistake then only he can be corrected but if we allow him to do the mistake and if we support him in it then he can never be corrected rather he will do that mistake brazenly. There are a lot of activities which are considered illegal though they are done by the mutual consent of the people like smoking in public, betting etc. But these are restricted because we know that it handicaps humanity and distort the future generations then why and how can we allow homosexuality to deteriorate our society and ruin the generations to come.
Religious Aspects
No religious book allow homeosexuality. Even we can’t find any mention of homosexuality in many religious books as it came out of lust completely. Life is not all about lust or enjoying materialistic things. The true meaning of life can be understood only by meeting a complete Guru or Sadguru. He explains why we are given human body? why we are are different from animals and what is the ultimate task of our life? Today there is only one sadguru in 21 universes and he is Saint Rampal ji Maharaj. He explained that after finding a sadguru and taking initiation from him by understanding the tatvgyan a devotee becomes less interested in materialistic pleasures. Similar essence can be withdrawn from the 46th shlok of chapter 2 of Geeta that whatever purpose that can be served by a small well of water is naturally served in all respects by a large lake. Similarly, one who realizes the Absolute Truth also fulfills the purpose of all the knowledge. The lust can be understood as a small well and the peace that we get after taking initiation from a Sadguru is like a huge source of water.
